Collapse LES High Tech Sector Royalty Rate & Deal Terms Survey 2014

Overview:

The LES High Tech Sector has again sponsored an in-depth royalty rate and deal terms survey similar to the highly sought after 2011 survey.  Covering the period from 2011 to 2014 - 1855 surveys were sent out; 94 complete deals were submitted by 53 companies for an overall 5% response rate.  The presenters will give an overview of the results of the survey along with the methodology that was used and discuss any apparent trends in the data.  The complete survey report is slated to be released to LES members in Q1 2015 and will be available for purchase by non-LES members.

  2. Extremely valuable data on deal types, royalty rates, payments, and technologies that comprised the reported deals

In general, the compensation terms of a typical license agreement, across all industries, involves a running royalty of 10% or less of net sales. Royalty rates higher that this amount exist but are rare. If a license fee is involved in the deal the amount will likely be $500,000 or less. Upfront licensee fees are not common.

2012 Survey Highlights

  • A total of 120 completed surveys were incorporated into the final Global BioPharma Survey Report. 
  • Of those who responded, 31% were from pharmaceutical companies, 22% were from biotech companies, 9% were from academic institutions, 6% were from government, and 32% were from other organizations.
  • The survey covered assets at all stages of development and the report offers a wealth of information on early stage programs. In all, 24% of the deals addressed assets in the discovery phase and another 16% covered programs that were on an IND track but had not yet been filed. 
  • Approximately 65% of the deals were considered “Global” in scope.

2011 Survey Highlights

  • The Survey received responses from 52 companies for the period from 2008 through 2011, with a total of 228 complete deals being submitted.  
  • The following major high technology fields were reported: aerospace, software, clean technology, communication, semiconductor, consumer products and electronics. 
  • 86% of respondents were licensors, with more than half of them entering the deal for monetary gain in addition to a strategic relationship.

    2010 Survey Highlights

    • Survey participation included academic institutions (34%), operating companies that ranged from big energy to start-up (39%), lawyers (16%), and other licensing organizations (11%). 
    • Approximately 70% of the deals collected contained flat running royalties and most deals were entered by the licensor. About 75% of the deals were executed during 2008 or 2009 and 80% of the deals came from the chemicals and energy sectors. 
    • Of those reported, approximately 40% of the deals estimated peak annual sales of less than $50 million, most deals involved commercialized or soon to be commercialized products/technologies and a majority of the deals were exclusive.
