The panelists at this Annual Meeting workshop reviewed licensing law cases that will be of significant interest to licensing practitioners. The cases may cause readers to change their agreements, not only for the countries where the cases were decided but also generally since some of the principles seem to have global application since they cover fundamental principles. The panelists covered cases from the United States (implied licenses for continuations and reissued patents), Europe (third party beneficiary rights of Affiliates, whether a covenant not to sue travels to the transferee of the subject IP Rights, and the obligation to pay royalties on a trade secret license if the trade secrets become public) and Japan (the effect of licensee failing to understand the scope of the licensed patents).
